Manufacturing

Manufacturing is considered to mean “undertaking any process by which the drug is extracted, produced, or refined; or takes part in the manufacture of the substance”. Here, charges and penalties will differ greatly based on the quantity of the drug, and whether you are charged with manufacturing a controlled substance or a controlled precursor.

Penalties for this charge:
  • Controlled substance
    • large commercial quantity—maximum fine of $500,000 and/or life in prison
    • commercial quantity—maximum fine of $200,000 and/ or 25 years in prison
    • trafficable quantity—fine of $50,000 and/ or 10 years in prison
  • Precursor
    • large commercial quantity— maximum fine of $200,000 and/or 25 years in prison
    • commercial quantity—maximum fine of $75,000 and/ or 15 years in prison
    • trafficable quantity— maximum $50,000 and/or 10 years in prison
